1. The agreement
These Terms of Service ("Terms") form a legally binding agreement between [Fork Time Pty Ltd, ABN XXX XXX XXX] and [Fork Time, Inc., a Delaware corporation] (together, "Fork Time", "we", "us") and the person or business that creates a Fork Time account or uses the Service ("you", "Customer", "the restaurant").
By creating an account, forwarding your phone number to Fork Time, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. The service
Fork Time is an AI front-of-house product for restaurants. The Service includes, depending on your plan:
- AI voice answering on a forwarded restaurant phone number, including reservation taking, FAQ handling, and message taking.
- A reservation system and host terminal accessible via web browser.
- Web chat embeds, ChatGPT discoverability, and structured-data publishing for generative AI assistants (e.g. via the hosted MCP server at
mcp.forktime.ai). - Native and middleware integrations with reservation systems, POS systems, and other third-party platforms.
We continuously improve the Service. Features may be added, changed, or removed. We will give reasonable notice for material reductions in functionality.
3. Eligibility & account
You must be at least 18 years old, legally able to enter contracts, and authorised to act on behalf of the restaurant whose phone, brand, and reservation data you connect to Fork Time. You are responsible for the accuracy of registration information and for keeping your account credentials confidential.
Each Fork Time account corresponds to one restaurant location unless explicitly licensed otherwise. Multi-location operators must license one account per location or contact us about a group plan.
4. Subscriptions, billing & refunds
Fork Time is a paid subscription service starting at US$49/month per location (current published pricing at forktime.ai/pricing applies; we may change pricing on at least 30 days' notice for new billing periods, but never retroactively for an in-progress period).
Billing is monthly in advance via Stripe. Subscriptions auto-renew until cancelled. Refunds are not provided for partial months; if you cancel mid-cycle, the Service remains active until the end of the paid period.
Failed payments after 7 days result in suspension of the Service. You remain responsible for fees accrued before suspension.
5. Free trial & "live in 60 minutes" promise
If we advertise a free trial, the trial is limited to one per restaurant. Trial accounts have full functionality but a per-call or per-cover cap as disclosed at signup.
If we promise a setup time on the marketing site (e.g. "live in 60 minutes") and we cannot get the Service operational on your forwarded number within that window, we will waive the first month's fee. The promise applies to setup, not to integration of every third-party reservation system or POS — those depend on third-party APIs we don't control.
6. Cancellation
You may cancel at any time from your account dashboard or by emailing support@forktime.ai. Cancellation takes effect at the end of the current billing period.
On cancellation, we will help you forward your phone number back to your previous carrier and export your reservation, knowledge-base, and call-log data within 30 days. After 90 days following cancellation, we may delete your data per the Privacy Policy.
7. Acceptable use
You may not use the Service to:
- Take bookings for, or operate, a business that is not the restaurant licensed under your account.
- Process calls for purposes other than restaurant front-of-house operations (e.g. you may not use the AI voice line as a generic call centre).
- Train competing AI models on Fork Time outputs without our written permission.
- Scrape, reverse engineer, or attempt to extract the underlying models or proprietary data Fork Time uses.
- Send marketing calls, spam, or robocalls through the Service.
- Configure the AI to make false or misleading statements about menu items, allergens, dietary information, or availability.
- Violate applicable telecommunications laws, including call-recording consent requirements (see Section 9).
We may suspend or terminate accounts that violate this section, with or without notice depending on severity.
8. Restaurant content & data
You retain all rights to your restaurant's content — menus, photos, hours, reservations, guest data, brand assets ("Restaurant Content"). You grant Fork Time a worldwide, royalty-free licence to use, store, transmit, and process Restaurant Content solely to provide the Service.
Guest data (names, phone numbers, party sizes, dietary notes captured during reservations) is collected on your behalf. You are the data controller; Fork Time is the data processor. The Privacy Policy and any Data Processing Addendum (DPA) govern this relationship.
9. AI voice, recordings & consent
The Service answers calls using synthetic voices and records call audio for transcription, quality, training, and dispute resolution.
You are responsible for ensuring your calls comply with recording laws in your jurisdiction. This includes:
- "Two-party consent" states in the United States (California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Washington, and others) which require disclosure that the call is recorded.
- Australian state laws (e.g. NSW Surveillance Devices Act, Victoria Surveillance Devices Act) which require disclosure or consent for recording.
- UK PECR / GDPR rules requiring lawful basis for recording.
Fork Time provides a configurable opening line that announces the AI nature of the call and the recording. You are responsible for keeping that disclosure enabled and accurate.
The AI is not perfect. It may mishear, misunderstand, or in rare cases generate an inaccurate response. The Service is designed to escalate uncertain situations to a human; you are responsible for reviewing reservations, monitoring escalations, and not relying on the AI for safety-critical advice (e.g. allergen information beyond what's in your knowledge base).
10. Third-party integrations
The Service integrates with third parties including (without limitation) Twilio, ElevenLabs, OpenAI, Anthropic, Stripe, Google, Apple, CloudWaitress, and reservation/POS systems you connect. Use of those services is also governed by their terms and policies. Fork Time is not responsible for outages, data loss, or behaviour of third-party services.
We will give reasonable notice before changing material subprocessors. The current list is published in our Privacy Policy and DPA.
11. Intellectual property
Fork Time and its licensors own the Service, including all software, models, prompts, voice configurations, branding, designs, and documentation. We grant you a non-exclusive, non-transferable, revocable licence to use the Service for your restaurant's operations during the term of your subscription.
Feedback you give us about the Service is non-confidential and may be used to improve the Service without obligation.
12. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Fork Time disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
We don't guarantee that every call will be answered, that every booking will be perfectly captured, that every integration will run without error, or that the Service will be free from bugs.
Nothing in this section limits any non-excludable consumer rights you may have under applicable law (including the Australian Consumer Law, the US Magnuson–Moss Warranty Act, or UK consumer protection law).
13. Limitation of liability
To the maximum extent permitted by law, Fork Time's total aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees you paid Fork Time in the 12 months preceding the claim or (b) US$1,000.
Fork Time is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost reservations, lost goodwill, or reputational harm, even if advised of the possibility.
14. Indemnification
You agree to indemnify and hold Fork Time harmless from any claim, loss, or expense arising from (a) your Restaurant Content, (b) your use of the Service in breach of these Terms, (c) your violation of recording or telecommunications law, or (d) your violation of any third party's rights.
15. Term & termination
These Terms apply for as long as you have an active account. Either party may terminate at any time per Section 6. Fork Time may terminate immediately for material breach (including non-payment after the cure period and Acceptable Use violations).
Sections 8, 11, 12, 13, 14, and 18 survive termination.
16. Modifications to these terms
We may update these Terms from time to time. Material changes will be announced by email and on the website at least 30 days before they take effect. Continued use of the Service after the effective date is acceptance of the updated Terms.
17. Beta features
Some features may be marked "Beta", "Preview", or similar. Beta features are provided without warranty, may be removed at any time, and are not subject to the SLA (if any). Fork Time disclaims all liability for Beta features beyond what is required by non-excludable law.
18. Governing law & disputes
If you signed up from Australia, New Zealand, or another non-US/EU country, these Terms are governed by the laws of [Queensland, Australia], and disputes are subject to the exclusive jurisdiction of the courts of [Brisbane, Queensland].
If you signed up from the United States, these Terms are governed by the laws of the State of [Washington] without regard to conflict-of-laws rules, and disputes are subject to binding arbitration administered by JAMS in [Seattle, Washington], except that either party may seek injunctive relief in court for IP claims.
If you signed up from the European Union or United Kingdom, you retain non-excludable consumer-protection rights under your local law.
19. Miscellaneous
If any clause is unenforceable, the rest remains in effect. We may assign these Terms to an affiliate or in connection with a sale or restructuring; you may not assign without our consent. Notices to Fork Time go to legal@forktime.ai; notices from us to you may be sent to the email on your account.
These Terms, together with the Privacy Policy and any Data Processing Addendum, are the entire agreement between you and Fork Time on the subject. Prior agreements (e.g. trial signups, marketing pages) are superseded.
